These Terms & Conditions and Terms of Sale (“Terms”) apply to purchases made from Serpentine Los Angeles (“Serpentine,” “we,” “us,” or “our”), including purchases made through our website, showroom, nursery, invoices, and direct sales.

By placing an order, submitting payment, or taking possession of an item, you acknowledge and agree to these Terms.

All Sales Are Final

Due to the living, vintage, antique, custom, and often one-of-a-kind nature of our inventory, all sales are final unless otherwise agreed to by Serpentine in writing prior to purchase.

We do not accept returns or exchanges based on change of mind, fit, scale, color variation, patina, natural variation, or other characteristics disclosed or reasonably visible at the time of purchase.

We encourage clients to request additional photographs, measurements, condition information, or plant-care guidance before completing a purchase.

Living Plants

Plants are living organisms whose appearance and health naturally change over time. Each plant is inspected and cared for prior to leaving Serpentine.

Once a plant leaves our care, its health may be affected by conditions outside of our control, including watering, light, temperature, humidity, airflow, pests, environmental changes, handling, transportation, placement, and maintenance.

For these reasons, Serpentine does not guarantee the continued health, appearance, growth, or survival of plants after pickup, delivery, or installation.

Plant-care guides and ongoing troubleshooting assistance are provided as a courtesy and for general guidance. Such recommendations do not constitute a warranty or guarantee.

Vintage, Antique & One-of-a-Kind Pieces

Many Serpentine pieces are vintage, antique, handmade, naturally aged, or one of a kind.

Variations and imperfections—including patina, discoloration, oxidation, surface wear, weathering, irregularities, previous repairs, chips, scratches, cracks, crazing, staining, and other evidence of age or use—may be present and are part of the character of these pieces.

Such characteristics are generally not considered defects.

Vintage and antique pieces are sold in their existing condition unless expressly stated otherwise in writing.

Natural Stone, Concrete & Other Natural Materials

Limestone, stone, concrete, fiber cement, wood, ceramic, and other natural or handmade materials may exhibit variations in color, texture, veining, porosity, finish, dimensions, weathering, fissures, surface irregularities, and patina.

These variations are inherent to the materials and are not necessarily defects.

Natural stone and other porous materials may also stain, weather, discolor, or otherwise change with exposure to water, soil, plants, weather, cleaning products, and normal use.

Product Photography & Appearance

We make reasonable efforts to accurately represent our inventory through photography and descriptions. However, photographs may not precisely reproduce an item's color, texture, scale, finish, condition, or appearance.

Plants may also change naturally between the time they are photographed and the time they are purchased or delivered.

Differences caused by lighting, photography, displays, screens, natural variation, or normal plant growth are not grounds for return or refund.

Measurements & Dimensions

All dimensions provided by Serpentine are approximate unless expressly stated otherwise.

Many of our pieces are organic, irregular, handmade, vintage, or unique in form. Measurements may therefore vary depending on where and how an item is measured.

Customers are responsible for confirming any critical dimensions before purchasing.

Site Access & Fit

Before purchasing large plants, furniture, vessels, stone pieces, or other oversized items, the customer is responsible for determining whether the item can safely enter and be placed within the intended location.

This includes confirming doorways, hallways, elevators, stairways, ceiling heights, turning clearances, loading areas, weight restrictions, and other access conditions.

Serpentine is not responsible if a purchased item does not fit through or within the customer's property.

Additional labor, equipment, redelivery, or other costs resulting from inaccurate or undisclosed access information may be charged separately.

Pickup

Unless otherwise arranged, purchases are available for pickup by appointment from our Boyle Heights showroom or nursery.

Customers and their representatives are responsible for arriving with an appropriately sized vehicle and appropriate equipment, labor, padding, restraints, and other materials necessary to safely transport their purchase.

When a customer or a third-party carrier picks up an item, responsibility for its handling and transportation transfers to the customer upon pickup.

Serpentine is not responsible for damage caused during transportation, unloading, handling, storage, or installation performed by the customer or a third party.

Delivery

Local delivery may be available for certain purchases for an additional fee and is subject to availability, item size, location, and site conditions.

Delivery quotes are based on the information provided to Serpentine before delivery. Additional fees may apply for stairs, elevators, difficult or restricted access, extended carries, oversized or unusually heavy pieces, additional labor, specialized equipment, waiting time, parking restrictions, or other circumstances not disclosed when the delivery was quoted.

Unless installation has also been purchased, delivery does not necessarily include placement, assembly, planting, potting, or installation.

Installation

Installation may be available for certain plants, vessels, furniture, and project-based purchases and will be quoted separately unless expressly included in the purchase price.

Customers are responsible for informing Serpentine of relevant site conditions before installation, including access restrictions, stairs, elevators, fragile surfaces, building requirements, irrigation, utilities, structural limitations, and other conditions that could affect the work.

Unexpected or undisclosed site conditions requiring additional labor, equipment, materials, or time may result in additional charges.

Third-Party Delivery & Service Providers

Serpentine may coordinate or recommend independent delivery companies, movers, installers, contractors, or other service providers.

Unless expressly stated otherwise, independent providers are separate businesses and are responsible for their own services.

Serpentine is not responsible for acts, omissions, delays, loss, or damage caused by independent third-party service providers to the extent permitted by applicable law.

Pickup Deadlines & Storage

Customers should arrange pickup or delivery within the timeframe communicated at the time of purchase.

If an item is not collected within the agreed period, Serpentine may charge reasonable storage fees due to the space and care required to maintain inventory.

Items requiring ongoing plant care may also be subject to maintenance charges during extended storage.

Any storage fees, extended-storage procedures, and treatment of property left uncollected for an extended period will be handled in accordance with applicable law.

Orders, Holds & Availability

Inventory is subject to availability. Because many Serpentine pieces are unique or one of a kind, an item is not considered sold or reserved until the required payment or deposit has been received and confirmed.

Serpentine reserves the right to correct pricing, description, inventory, or administrative errors and, where legally permitted, to cancel an order affected by a material error and refund amounts paid.

Deposits & Custom or Project Orders

Deposits for custom sourcing, special orders, project work, installations, or other services may be non-refundable once work, sourcing, procurement, fabrication, or other project-related expenses have begun, as specified in the applicable proposal or invoice.

Project-specific proposals, invoices, or agreements may contain additional terms. If those terms conflict with these Terms, the terms of the project-specific written agreement will control with respect to that project.

Cancellations

Because one-of-a-kind inventory is removed from availability once sold, completed purchases generally cannot be canceled.

Any cancellation or modification permitted by Serpentine is at our discretion and may be subject to costs already incurred, including transaction fees, sourcing costs, labor, delivery expenses, or other nonrecoverable expenses, to the extent permitted by applicable law.

Care & Maintenance

Customers are responsible for the appropriate care and maintenance of purchased items after pickup, delivery, or installation.

This includes plants as well as stone, concrete, vintage furniture, vessels, ceramics, metals, wood, and other materials that may require specific maintenance.

Serpentine may provide care recommendations; however, recommendations are general in nature and cannot account for every environment, condition, or use.

Outdoor Use

Customers are responsible for determining whether an item is appropriate for its intended indoor or outdoor environment.

Exposure to sunlight, rain, moisture, freezing temperatures, irrigation, salt air, heat, wind, soil, or other environmental conditions can alter or damage plants, furniture, stone, vessels, and other materials.

Unless expressly represented by Serpentine in writing for a particular item, no representation is made that an item is suitable for permanent outdoor exposure.

Warranty Disclaimer

Except for any warranties that cannot legally be excluded, Serpentine products are sold as-is and as available.

To the fullest extent permitted by applicable law, Serpentine disclaims implied warranties regarding condition, durability, fitness for a particular purpose, continued plant health, or suitability for a particular location or use.

Nothing in these Terms is intended to waive or limit rights that cannot lawfully be waived under applicable consumer-protection law.

Limitation of Liability

To the fullest extent permitted by applicable law, Serpentine will not be liable for indirect, incidental, special, or consequential damages arising from the purchase, possession, transportation, installation, care, maintenance, or use of our products.

Where liability cannot legally be excluded, Serpentine's liability will be limited only to the extent permitted by applicable law.

Website Information

We make reasonable efforts to keep product descriptions, pricing, dimensions, availability, and other website information accurate. However, errors may occasionally occur.

We reserve the right to correct errors or update information, subject to applicable law.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Changes to These Terms

Serpentine may update these Terms from time to time. The version in effect at the time of purchase will generally apply to that transaction unless otherwise required by law.
